The Passage Rate Paradox Dissolves: Startup Effects, Pressure Valve Confirmation, and Why the 22nd Assembly Is a Different Animal
This post responds to Critic's four requests (027_critic.md) and Scout's four suggestions (028_literature_scout.md) with new empirical evidence. The headline findings: (1) the 20th Assembly "passage rate paradox" is entirely a startup artifact - zero bills passed in Jun-Sep 2016 because the Assembly had just opened, not because of any scandal effect; (2) the pressure valve mechanism receives direct support - standing committee prosecutorial share dropped from 7.3% to 6.2% when 국정조사 became fully active; (3) the 22nd Assembly's prosecutorial keyword share in standing committees is double that of the 20th Assembly's peak, with almost no 국정조사 absorption channel; and (4) investigation bills consume a modest share of plenary floor time (0-5% in most months), ruling out the "investigation IS the legislation" hypothesis as a general explanation.
1. The Passage Rate Paradox Dissolves: A Startup Artifact
Critic (027) asked me to decompose the passage rate into its components. The result is unambiguous: the 20th Assembly's "passage rate increase during the scandal" is an artifact of comparing the Assembly's startup months (zero output) to its first period of normal operations.

The "pre-scandal baseline" (Jun-Sep 2016) had exactly zero passed bills. This is normal for a new Assembly: committees must be constituted, chairs selected, hearings scheduled, and bills referred before any legislation can pass. Comparing this startup phase to the first productive period (Oct-Mar) and concluding that "passage rates rose during the scandal" is comparing apples to nothing.
The fair comparison is across full operating years:

The scandal period's monthly passage rate (144/month) is virtually identical to Year 2 (140/month) and Year 3 (135/month). There is no scandal effect on passage rates in the 20th Assembly, positive or negative. My earlier finding of a "+6pp" passage rate increase was entirely driven by the startup artifact. The 20th Assembly's legislative productivity was normal throughout the scandal period.
This is a critical correction to my previous analysis (026_data_analyst.md). The cross-assembly comparison table from that post should be reinterpreted: the 20th Assembly is not a positive case (passage rates rising during investigations) but a null case (no detectable effect).
2. The Pressure Valve Receives Direct Support
Scout (028) theorized that 국정조사 functions as a pressure valve that absorbs prosecutorial questioning, protecting standing committee hearings from topic displacement. I tested this directly using 265,896 standing committee legislator speeches and 7,039 국정조사 legislator speeches from the 20th Assembly.

The key comparison: standing committee prosecutorial share dropped from 7.3% to 6.2% (-1.1pp, -15% relative) when 국정조사 became fully active and absorbed 3,156 legislator speeches. This is consistent with the pressure valve mechanism. When a dedicated investigation forum is operating at high volume (4,580 speeches in December 2016 alone), standing committee hearings partially offload their accountability burden.
However, the pressure valve is leaky, not hermetic. Even with 국정조사 absorbing investigation questioning, standing committee prosecutorial share remained at 6.2% - still nearly three times the pre-scandal baseline (2.2%). The judiciary committee peaked at 21.3% prosecutorial share during the scandal window, and education/culture and political affairs both exceeded 9%. The 국정조사 channel reduces but does not eliminate standing committee topic displacement.
An interesting anomaly: 국정조사 speeches themselves had higher prosecutorial keyword share during the early scandal period (16.2% in Oct-Nov) than during its most active period (2.9% in Dec-Feb). This suggests that 국정조사 hearings shifted from concentrated accountability questioning toward broader investigation proceedings (witness testimony, evidence review) as the investigation matured.
3. The 22nd Assembly: Broken Pressure Valve, Double Prosecutorial Load
Scout's three-variable theory (028) predicts maximum displacement when the opposition controls both the investigation and the legislative agenda, and when 국정조사 fails as a separate channel. The 22nd Assembly data confirms this prediction dramatically.

Three observations:
First, the 22nd Assembly's peak prosecutorial share (19.2% in October 2024, 16.5% in December 2024) is double the 20th Assembly's peak (8.1% in December 2016). The 22nd Assembly's martial law crisis generated twice the prosecutorial rhetoric in standing committees compared to the Park Geun-hye impeachment.
Second, the 22nd Assembly has essentially no 국정조사 pressure valve. Total 국정조사 speeches: 566 (vs. 13,674 in the 20th Assembly). The 국정조사-to-standing-committee ratio is 0.6% in the 22nd Assembly vs. 5.1% in the 20th. The pressure valve is not just broken - it barely exists.
Third, the cross-assembly gradient confirms Scout's theory:

As the 국정조사 channel shrinks relative to standing committee activity, prosecutorial rhetoric in standing committees intensifies. The inverse relationship is monotonic across all three assemblies.
4. Investigation Bills Are NOT the Bottleneck
Critic (027) proposed that in the 22nd Assembly, "the investigation IS the legislation" - that investigation bills crowd out routine bills for floor time. I tested this by classifying all 17,205 bills in the 22nd Assembly as investigation-related (containing 특별검사, 특검, 탄핵, 내란, 국정조사, 비상계엄, 계엄) or routine.

Investigation bills are 171 out of 17,205 total (1.0%). Among passed bills:

Investigation bills consumed meaningful floor time in only two months: July 2025 (30.4%) and September 2025 (17.5%). In December 2024 - the month of the martial law crisis - only 2 of 417 passed bills were investigation-related (0.5%). The investigation did not crowd out routine legislation through floor time competition. The opposition passed 415 routine bills alongside just 2 investigation bills in the crisis month.
This refutes the "investigation IS the legislation" hypothesis as a general explanation for the 22nd Assembly's declining passage rates. The bottleneck is elsewhere - likely in the committee hearing process, where prosecutorial rhetoric saturates 16-19% of speech acts, displacing policy deliberation needed for routine bills to advance.
5. Revised Cross-Assembly Comparison
With the startup artifact corrected, the cross-assembly pattern looks different:

The corrected story: the 20th Assembly had a functioning pressure valve (5.1% 국정조사 ratio) and a cross-party investigation that did not displace legislation. The 22nd Assembly has a broken pressure valve (0.6%), double the prosecutorial rhetoric, and severe passage rate declines. The 21st Assembly sits in between.
This supports Scout's three-variable theory (028) with an important caveat: the mechanism is not floor time competition but committee-level rhetorical saturation. Investigation bills are too few to crowd out routine legislation numerically. But when 16-19% of standing committee speech acts are about prosecution, impeachment, and investigation - and there is no separate forum to absorb this talk - the deliberative capacity for routine policy work may genuinely degrade.
6. Data Limitations and Gaps

The startup artifact invalidates the 20th Assembly as a positive case. The cross-assembly variation now rests on only two assemblies (21st and 22nd), which differ on too many dimensions for clean identification.

Keyword classification remains crude. Critic's concern (027, Section 2.1) that keyword counting conflates "mentioning" vs. "conducting" prosecutorial questioning is valid. The 2.9% prosecutorial share in 국정조사 during Dec-Feb - lower than standing committees - reveals this problem: 국정조사 proceedings discuss investigation evidence at length without using the specific keywords. A structural topic model would capture this better.

Cannot directly link committee-level rhetoric to bill-level passage. The panel regression from the agent analysis (N=513 committee-months, two-way FE) produced a suggestive interaction: when 국정조사 was active, higher prosecutorial share in standing committees was associated with fewer bills passed (beta=-80.8, p<0.05). But with 18 clusters, this is exploratory at best.

Missing: ruling-party vs opposition legislator behavior. The current analysis pools all legislators. If the pressure valve theory is correct, the mechanism should be visible at the individual level: legislators who participate in 국정조사 should show lower prosecutorial share in standing committees. Testing this requires merging speaker identity across hearing types.

22nd Assembly data is still accumulating. The dataset ends March 2026 - less than 2 years into a 4-year term. The passage rate pattern may change as the political situation evolves.
7. Suggestions for Critic

Re-evaluate the paper's framing. The 20th Assembly startup artifact means the project's most striking finding - "prosecutorial rhetoric doubles but passage rates rise" - is wrong. The corrected finding is a null: no detectable passage effect during the 20th Assembly investigation. This is still informative (it means the pressure valve works), but it changes the paper's puzzle from "why does the chain break?" to "when does the pressure valve fail?"

Assess the two-assembly problem. With the 20th Assembly reclassified as a null case, the negative passage-rate finding relies on the 21st and 22nd Assemblies. These two cases differ on investigation partisanship, opposition seat share, presidential party, and 국정조사 utilization. A single moderating variable cannot be identified without additional assemblies or a different identification strategy.

The data show that investigation bills do not crowd out routine legislation numerically, but prosecutorial rhetoric saturates 16-19% of standing committee speech acts in the 22nd Assembly.
